REGULATIONS FOR THE USE OF APARTMENTS
§ 1
INTRODUCTION
- The following regulations (hereinafter referred to as „Regulations” ) apply to the rental of residential apartments by Dariusz Czajkowski running a business under the name of GRUPA TESPIS located in Katowice at ul. Francuska 106/U1, 40-507 Katowice, NIP 5471311819, REGON 365302215 hereinafter referred to as „Tespis Group”.
- The rental agreement can only be concluded by an adult person, hereinafter referred to as the „Tenant”.
- The following rental agreement is formed by these regulations (hereinafter referred to as “Regulations” and the Registration Card. In the event of discrepancies between the contents of Regulations and contents of the Registration Card , the provisions of the Registration Card have priority
- The Tenant is entitled to use the Apartment on the days and hours specified in the Registration Card only for residential purposes
- The Apartment is made available to the Tenant solely to meet the housing needs related to a short-term stay, in particular, related to the business trip, cultural or sports event. The apartment is not intended to meet the Tenant’s housing needs related to the permanent stay of the Tenant and other persons.
§ 2
CHECK IN
- The hotel day lasts from 2:00 p.m. to 11:00 a.m. the next day.
- The Tenant is obliged to check in and collect the keys to the Apartment at the Tespis Group Reception in Katowice at ul. Francuska 106/U1 from 14:00 to 22:00 on the agreed day of arrival.
- At the time of check-in, the Tenant is obliged to identify himself with a valid ID document containing a photo.
- The Tespis Group reserves the right to refuse check-in to persons under the influence of alcohol or drugs. In such a case, the first hotel night fee is non-refundable. In the case of stay lasting longer than 1 hotel day, the Tenant is entitled to check in to the Apartment on the next day.
- Check-in and collection of the keys to the Apartment are also possible in the Apartment and/or after 22:00. In such a case, the Tenant will pay an additional fee in accordance with § 9 section 1 point a) of the Regulations - prepayment, no later than upon check-in.
- On the day of arrival, the Tenant will receive a key to the Apartment's entrance door and a code to the building's entrance door. The Tenant is obliged to lock the Apartment each time he leaves it and not to provide the key or code to persons who are not registered in the Apartment.
§ 3
RULES OF THE USE OF THE APARTMENT
- Only persons listed in the Registration Card are allowed to stay in the Apartment.
- During the stay, the Tenant has the right to receive guests only prior to the Landlord’s consent and only from 8:00 a.m. to 10:00 p.m
- If it is found that any additional persons other than the registered persons are staying in the Apartment without the consent of the Tespis Group, the Tenant is obliged to pay the contractual penalty referred to in § 8 section 1 point a) for each person, for each day of stay of this additional person in the Apartment. The Tenant's guests who will stay in the Apartment between 10:00 p.m. and 08:00 a.m. will be treated as additional registered persons, and the Tenant is obliged to pay for the stay of each additional person in accordance with the pricing plan applicable on a given day indicated in the Registration Card
- Minors may stay in the Apartment only accompanied by and under the care of their legal guardians
- Staying in the Apartment with animals is possible only with the consent of the Tespis Group and provided that the additional fee referred to in § 9 section 1 point b) of the Regulations is paid in advance - payable in advance at the latest at the time of check-in. If it is found that animals are staying in the Apartment without the consent of the Tespis Group, the Tenant is obliged to pay a contractual penalty in accordance with § 8 section 1 point b) of the Regulations.
- The Tenant is obliged to use the Apartment in accordance with its intended purpose and to ensure its proper technical condition.
- The Tenant is obliged to follow the principles of good neighborliness, night silence, and comply with house rules. Night silence is valid from 10:00 p.m. to 8:00 a.m. In the event of a violation of any of the above by any person staying in the Apartment, the Tenant will pay the contractual penalty referred to in § 8 section 1 point c) for each event.
- Organizing parties, including loud parties, is strictly prohibited in the Apartment. A party is understood here as the use of the Apartment for non-residential purposes combined with the presence of a larger number of people and disruption of household order. If a violation of this prohibition is found, the Tenant will pay the contractual penalty referred to in § 8 section 1 point d). In the event of violation of this prohibition, regardless of the payment of the contractual penalty, the Tespis Group will be entitled to terminate the contract with immediate effect. In such a case, the fee paid by the Tenant for the stay is non-refundable.
- If the Apartment is used contrary to its intended purpose and/or these Regulations, as well as in the event of deterioration of the technical condition of the Apartment or its equipment, the Tespis Group has the right to terminate the Agreement with immediate effect. The Tenant is not entitled to a refund for the unused period of stay.
- In situations requiring it, the Tespis Group is entitled to notify the Police or other relevant services.
- Taking any photo sessions or video materials in the apartments is strictly prohibited. In special cases, it is only possible with the consent of the Lessor and after paying an additional fee.
§ 4
TENANT’S LIABILITY
- The Tenant is responsible for any damage caused to the Apartment. The Tenant assumes responsibility for persons registered in the Apartment, guests and all persons present in the Apartment at that time, animals included. The Tenant's liability is joint with these persons. The damage includes in particular all damages and deficiencies in the Apartment as well as expenses related to restoring the Apartment to the condition at the time of handing over the Apartment to the Tenant. Also, the damage includes the lost income of the Tespis Group for each day on which the Apartment will be unused due to this damage.
- If the Tenant finds any damage to the equipment or malfunctions in the operation of the equipment in the Apartment, they should immediately report this fact to the Tespis Group. Otherwise the Tenant may be charged with the costs of repairing or removing the damage.
- The Tespis Group reserves the right to collect a deposit from the Tenant (in the amount from PLN 500 to PLN 1,000) to secure any damage to the Apartment, missing equipment or to cover the above-mentioned contractual penalties. The deposit will be returned to the Tenant in full within 3 business days of departure (in the case of cash payment - by transfer to the Tenant's Polish account or foreign account with deduction of appropriate commissions; in the case of card payment - to the card) or reduced by the sum of any contractual penalties due and the sum of funds necessary to cover damages should they occur. If the deposit does not cover all damage or missing equipment, the Tenant is obliged to cover the difference between the amount of the deposit and the value of the damage caused.
- If damage is found in the Apartment or its equipment, the parties will prepare a damage report in which they will describe the damage. In the report, the parties will indicate the estimated value of the damage. If the Tenant refuses to sign the damage report or does not participate in this activity, the Tespis Group is entitled to individually prepare the damage report in the presence of at least 2 people. In order to document the damage, the photo documentation will be taken and the Police will be called.
§ 5
KEEPING ORDER IN THE APARTMENT
- It is the Tenant's obligation to keep the Apartment tidy and clean on an ongoing basis - in a condition adequate to the normal use. The apartment has all the necessary equipment, such as cleaning products.
- The apartment is subject to a thorough cleaning before being made available to the Tenant. The rental price also includes the final cleaning of the Apartment. At the Tenant's request, it is possible to clean the Apartment during the stay. An additional fee is charged for cleaning during the stay, referred to in § 9(1)(c).
- Smoking tobacco and other substances is strictly prohibited in the Apartment. In apartments with a balcony, smoking is allowed on the balcony. If it is found that this prohibition has been violated by any person staying in the Apartment, the Tenant will pay the contractual penalty referred to in § 8 section 1 point e) for each case.
- The dishwasher can only be used with "3 in 1" cubes to ensure its proper operation.
- There is a washing machine in the bathroom at the Tenant's disposal, which the Tenant can use at their discretion. The Tespis Group does not provide any washing products.
- If the Apartment is left in a condition that requires increased work to clean it, the Tenant is obliged to pay the contractual penalty referred to in § 8 section 1 point f) of the Regulations.
§ 6
CONTACT AND OBLIGATIONS OF THE LANDLORD
- During the rental period, the Tespis Group is at the Tenant's disposal on weekdays from 8:00 a.m. to 10:00 p.m. and on weekends from 10:00 a.m. to 10:00 p.m. at the telephone numbers +48 32 702 32 32, +48 736 600 301.
- The Tespis Group reserves the right not to answer the phone in the event of professional activities, ensuring that you will be contacted as soon as possible.
- The Tespis Group is obliged to ensure that the condition of the Apartment and its equipment is consistent with the offer presented to the Tenant on the day of making the reservation.
- The Tespis Group is obliged to respond to any irregularity reported by the Tenant (e.g. in the operation of equipment or equipment condition), and if it is not possible to remove this irregularity, compensate the Landlord for the related inconvenience by reducing the price adequate to the duration and scope of the irregularity.
- The Tespis Group is not responsible for valuable items of the Tenant and of other persons using the Apartment left in the Apartment.
- The Tespis Group is not responsible for shortages in the supply of electricity/water and heat that are not due to the Landlord's negligence (e.g. lack of electricity in the entire district due to a generalized fault).
§ 7
RENTAL DURATION
- After the end of the agreed period of renting the Apartment, the Tenant is obliged to hand it over in a condition consistent with the provisions of the Regulations.
- The check-out and return of keys always take place at the reception desk and without additional fees.
- In the event of loss or failure to return the original door key or garage door remote control, the Tenant will be obliged to pay a contractual penalty in the amount indicated in § 8 section 1 point g).
- The apartment should be handed over to the Tespis Group on the day of departure no later than 11:00 a.m. Each deviation from these rules requires the consent of the Tespis Group and is subject to additional fees in accordance with § 9 section. 1 point d) of the Regulations.
- In the event of a delay in handing over the Apartment not agreed with the Tespis Group, the Tenant is obliged to pay a contractual penalty in the amount of: a) up to 3 days of delay - twice the gross price for the last hotel day specified in the Registration Card, for each day of delay in handing over the Apartmenrt, b) more than 3 days of delay - three times the gross price for the last hotel day specified in the Registration Card, for each day of delay in handing over the Apartment.
- The contractual penalty referred to in section 5 is due until the Apartment is handed over to the Tespis Group and emptied of the Tenant's persons and items.
§ 8
CONTRACTUAL PENALTIES
- In the cases included in these Regulations, the Tespis Group is entitled to demand that the Tenant pay a contractual penalty in the following amounts:a) PLN 150 in the event of any additional persons other than registered persons staying in the Apartment without the consent of the Tespis Group - PLN 150 for each person
b) PLN 500 if animals are found staying in the Apartment without the consent of the Tespis Group,
c) PLN 500 for each case of violating the principles of good neighborliness, silence at night and house order,
d) PLN 1.000 for each case of a party and loud entertainment,
e) PLN 400 for each case of violating the ban on smoking tobacco and other substances,
f) PLN 150-300 if the Apartment is left in a condition that requires increased work to clean it
g) PLN 200 in the event of loss or failure to return the original key to the Apartment door, key fob or garage gate remote control h) PLN 100 for each commenced hour of extending the rental without the consent of the staff. i)PLN 1.000 Taking a photo session/video material in the apartment and publishing it without the consent of the Landlord.
- The contractual penalties provided for in these Regulations do not exclude the right of the Tespis Group to demand compensation in an amount exceeding the amount of the agreed contractual penalties, if, due to the action or omission of the Tenant or persons for whom the Tespis Group is responsible, the Tespis Group suffers damage exceeding the amount of the stipulated contractual penalty.
- Contractual penalties are payable no later than 7 days from the date the Tespis Group calls the Tenant for payment.
- The Tenant allows the Tespis Group to deduct the due contractual penalties from the amount of the refundable deposit paid by the Tenant, as well as to collect them from the amount blocked on the Tenant's credit or debit card account.
§ 9
ADDITIONAL FEES
- In the cases included in the Regulations, the Tenant is obliged to pay the following additional fees:a)PLN 50-120 – fee for check-in and collection of keys to the Apartment in the Apartment and/or after 10 p.m.,
b)PLN 60 – fee for staying in the Apartment with animals - payable for each animal per day,
c)PLN 120 – fee for cleaning the Apartment during your stay,
d) PLN 100-250 - fee for a later time of handing over the Apartment on the day of departure. - All additional fees are payable in advance upon check-in and must be confirmed in advance with the Landlord.
§ 10
ONLINE BOOKING RULES
1. The reservation is considered confirmed upon payment of the required prepayment - in the amount and date indicated in the e-mail confirmation of the reservation.
2. RESERVATION ON REQUEST - if the accommodation is not available online, Reservation On Request may be offered. Confirmation of the availability of the date (or lack thereof) and information on how to make the prepayment will be sent by e-mail or telephone.
3. Non-refundable offer - favorable priceTo confirm this reservation, the entire stay must be paid in advance. In case of cancellation or change of reservation or no-show on the day of arrival, the amount paid is non-refundable.
4.Partially-refundable offerThe reservation can be canceled free of charge up to 7 days before arrival. In such a case, the prepayment (50% of the total amount for the reservation) will be refunded within 7 days of reporting the cancellation. In case of cancellation after this date or no-show on the day of arrival, the property will charge the guest 50.00% of the reservation value. To guarantee your reservation, you must provide your credit card details or make a prepayment of 50.00% of the reservation value via the online payment system.
§ 11
COMPLAINTS
1.Guests have the right to submit complaints if they notice any deficiencies in the quality of services provided.
2. All complaints are accepted by the reception in an electronic form via e-mail to the following address: apartamenty.tespis@gmail.com.
3. It is recommended that the Guest provide in the description of the complaint: - information and circumstances regarding the subject of the complaint, in particular, the type and date of occurrence of the infringement or other defect, and - contact details of the person filing the complaint - this will facilitate and speed up the consideration of the complaint.
4. A complaint should be submitted immediately after noticing any deficiencies in the standard of services provided. Complaints submitted after leaving the apartment will not be considered.
5. The complaint processing time is 14 days from sending the notification.
§ 12
FINAL PROVISIONS
- Any disputes related to the rental of the Apartment will be resolved by the local court belonging to the district in which the Apartment is located.
- In cases not regulated by these Regulations, the provisions of a generally-applicable law shall apply, in particular, the Civil Code.
I declare that I have read the provisions of these Regulations and that they are clear to me and do not raise any doubts. I also declare that the Regulations were delivered to me before concluding the contract and their content was previously agreed with me.
